The News

The family of Charlie Kirk has filed a notice of claim against the state of Utah and Utah Valley University, alleging that security failures allowed the Turning Point USA founder to be assassinated on the school's campus.

The filing alleges UVU failed to secure rooftops and ignored warnings before the shooting, according to the legal filing described by Yahoo News.

A notice of claim is the preliminary step required before a lawsuit can be filed against a public entity in Utah, RSBNetwork reported. The family is pursuing a wrongful death case.

The Allegations

Mediaite reported the claim alleges several security failures by campus police in the run-up to the killing. Yahoo News reported the filing says the university knew of a rooftop security risk before Kirk was shot.

Timeline

2025

Charlie Kirk, the founder of Turning Point USA, is shot and killed while appearing on the Utah Valley University campus in Orem, Utah.

Sept. 16, 2026

Just over a year after the killing, Kirk's family files a notice of claim against the state of Utah and UVU, the preliminary step toward a wrongful death lawsuit. The Associated Press reports the family says security failures by Utah officials led to the assassination.

Reactions

The family's position is laid out in the filing itself: that the university and the state had warning of the risk — specifically an unsecured rooftop — and did not act on it.

Right-leaning outlets moved fastest on the story. Citizen Free Press led with the flat claim that Kirk "was not protected" at UVU, and RSBNetwork framed the filing as the start of a wrongful death case against the university.

The coverage reviewed for this article did not include a response from Utah Valley University or the state of Utah.

What's Next

The notice of claim is not a lawsuit. It is the required advance warning to a government defendant, and it starts the clock for the state and the university to respond before the family can take the case to court.

Expect the substance of the fight to be what UVU knew about the rooftop, when it knew it, and what campus police did with that information.

More

The claim names both the university and the state, which matters: it puts the conduct of public employees — campus police among them — at the center of the case rather than treating the shooting as an act no one could have anticipated.
