Judge Blocks Mamdani's Pied-à-Terre Tax

A Staten Island judge on Monday temporarily blocked the rollout of New York City Mayor Zohran Mamdani's pied-à-terre tax on second homes, handing a win to homeowners who sued over the program.
Staten Island Supreme Court Justice Wayne Ozzi issued a temporary restraining order that effectively prohibits any action on the luxury second-home surcharge.
Ozzi also ordered the Mamdani administration to take down a list that exposed the names and addresses of more than 900,000 New York City homeowners.
The city said it will appeal.

Last week, homeowners filed suit over the property surcharges tied to the new tax.
On Monday, August 10, Justice Ozzi granted the temporary restraining order pausing enforcement and directing the city to remove the homeowner list.
Reactions
The mayor's office signaled it would fight the decision, saying in a statement: "We disagree with today's ruling, but we are confident in both the pied-à-terre surcharge and the City's ability to implement it fairly and effectively."
Critics cheered the ruling. The New York Post editorial board praised Justice Ozzi for "derailing" the tax and cast the homeowner list as an "enemies list," warning that the policy still puts second-home owners "on notice."

The city plans to appeal the ruling, setting up a further court fight over whether the tax can move forward.
For now, enforcement of the pied-à-terre surcharge is on hold and the public homeowner list must come down.
